Terms of Service for BRAPS

1. Acceptance of Terms

By downloading, accessing, or using the BRAPS mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

BRAPS is a social audio sharing platform that allows users to:

• Create accounts and profiles
• Upload and share audio recordings
• Comment on and interact with other users' content
• Follow and unfollow other users
• Report inappropriate content
• Access both free and premium features

3. Eligibility

You must be at least 13 years old to use BRAPS. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. User Accounts

Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You are fully responsible for all activities under your account
• You must notify us immediately of any unauthorized use of your account

Account Termination

• You may delete your account at any time through the App settings
• We may suspend or terminate your account for violation of these Terms
• Upon termination, your right to use the App ceases immediately

5. User Content and Conduct

Your Content

• You retain ownership of the audio recordings and content you upload ("User Content")
• By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content through the App
• You are solely responsible for your User Content and its legality, reliability, and appropriateness

Prohibited Content

You agree NOT to post content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Contains hate speech, discriminatory language, or promotes violence
• Infringes on intellectual property rights of others
• Contains explicit sexual content or nudity
• Promotes illegal activities or substances
• Contains spam, advertising, or solicitations
• Impersonates another person or entity
• Contains malware, viruses, or harmful code

Content Moderation

• We reserve the right to review, monitor, and remove any User Content
• We may remove content that violates these Terms without notice
• Users can report inappropriate content through the App's reporting feature
• Repeated violations may result in account suspension or termination

6. Acceptable Use

You agree to use BRAPS only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App in any way that could damage, disable, or impair the service
• Attempt to gain unauthorized access to other accounts or systems
• Use automated scripts, bots, or other automated means to access the App
• Harass, abuse, or harm other users
• Create multiple accounts to evade bans or restrictions
• Interfere with or disrupt the App's functionality

7. Premium Features and Payments

Free vs. Premium Access

• Basic App features are currently available at no cost
• We reserve the right to introduce premium features that require payment
• Premium features may include enhanced posting capabilities and additional content options

Payment Terms (Future Implementation)

• Premium features will be offered through in-app purchases
• All payments are processed through Apple's App Store payment system
• Payments are non-refundable except as required by applicable law
• Premium subscriptions will automatically renew unless canceled

Quality Control

• Premium posting features may be introduced as a quality control measure
• We reserve the right to modify pricing and feature availability

8. Intellectual Property

Our Rights

• BRAPS, our logo, and all related trademarks are our property
• The App's design, functionality, and code are protected by intellectual property laws
• You may not copy, modify, or create derivative works of the App

Respect for Others' Rights

• You must respect the intellectual property rights of others
• If you believe your copyright has been infringed, contact us immediately
• We will respond to valid copyright notices in accordance with applicable law

9. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to the collection and use of information as described in our Privacy Policy.

10. Disclaimers and Limitations of Liability

Service "As Is"

• The App is provided "as is" without warranties of any kind
• We do not guarantee uninterrupted or error-free service
• We are not responsible for User Content or interactions between users

Limitation of Liability

• To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you have paid us in the past 12 months
• Some jurisdictions do not allow these limitations, so they may not apply to you

Third-Party Content

• The App may contain links to third-party websites or services
• We are not responsible for third-party content, products, or services
• Your interactions with third parties are solely between you and them

11. Indemnification

You agree to defend, indemnify, and hold harmless BRAPS, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights

12. Dispute Resolution

Governing Law

These Terms are governed by the laws of Your State/Jurisdiction, without regard to conflict of law principles.

Arbitration

Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration, except for:

• Small claims court matters
• Injunctive relief requests
• Intellectual property disputes

Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the App
• Sending you an email notification (if applicable)
• Displaying a prominent notice in the App

Your continued use of the App after changes constitute acceptance of the new Terms.

14. Termination

By You

You may stop using the App and delete your account at any time.

By Us

We may suspend or terminate your access for:

• Violation of these Terms
• Illegal or harmful behavior
• Extended period of inactivity
• Technical or security reasons

Effects of Termination

• Your license to use the App ends
• We may delete your account and User Content
• Provisions regarding liability, indemnification, and dispute resolution survive

15. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BRAPS.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

Assignment

You may not assign these Terms without our written consent. We may assign these Terms at any time.

Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control.

Apple App Store

• Apple has no obligation to provide support for the App
• You acknowledge that Apple is a third-party beneficiary of these Terms
